  • Assessing the course of dealings between a mortgage warehouse lender and a mortgage broker in light of the broker’s fraudulent mortgage lending, misuse of warehouse funds and alleged Ponzi scheme.
  • Providing expert testimony in numerous matters involving financial institution failures attributed, in part, to the contraction of the primary and secondary mortgage markets, and a downturn in the construction and real estate development industries requiring the study of the entire U.S. real estate market with particular focus on Alabama, Florida, Georgia, Louisiana, Mississippi and Texas.
  • Analyzing mortgage loan portfolios against the backdrop allegations of fraudulent underwriting practices and self-dealing among senior executives.
  • Investigating the servicing arrangements related to mortgages backed by government agencies, in particular the duties required by a servicer pursuant to FHLMC, FNMA, and GNMA requirements.
  • Identifying potentially fraudulent forward trades of agency securities in the To Be Announced mortgage-backed securities market in conjunction with the relationship between a mortgage originator and a mortgage warehouse lending institution.
  • Assessing the mortgage documentation required to form a complete agency-backed mortgage file and allow for certification by the agency’s custodian.
  • Investigating other intervening causes for losses suffered by agency-backed loan portfolios resulting from the housing crisis and subsequent economic downturn.
